Approximately 2 years ago I was involved in a an accident in rural Ashland County Ashland, Ohio which
occurred as I was traveling south bound on a rural hard surface Township Road @approximately 40Mph
in a 55mph area,and occurred when a vehicle operated
by a Auto Owners Insurance Company Insured Failed
to Stop and Look for Traffic Before Entering a
roadway from a Private drive as required by Ohio Law.
I attempted to avoid and went left of the Centerline of the Township Rd (fortunately no other oncoming traffic) but the Operator Still failed to get stopped 10-12'into my lane of travel!
Her Company Auto Owners conducted a So-called Investigation in which her Auto Owners Adjuster made a check of other Insurers to see if any claims had been paid on the truck.
They contacted State Farm Insurance Company who
Shared Information with them, the Auto Owners
Adjuster then came back to me Stating If State Farmdid not Pay Neither will We! Had a complete investigation by a competent Adjuster been made
they would have determined that I Own 2 One Ton
Vehicles a 83 Chevy and a 85 GMC and that they are
quite different and that they were denying me for
damage on the other vehicle.
They have thru a Sad Comedy of errors and mistakes
and half truths, forced me to file suit to get anything,It turns out their Insured Carries $500,000 limits, which appears to be their Motivation.
As they profess to Know the provisions of The Ohio Fair Claims Practices Act and despite this have Countless times violated the provisions and Spirit of the Ohio Law.
In Ohio this act and Prior 1954 Insurance law have
been merged part Ohio Revised Code the other Adopted as Administrative Law.
Read about the Zoppo Ohio State Supreme Court Decision and a number of other recent decisions.
Upon reporting wrong doing to the Director of the Ohio Department of Insurance the reply it was not their job to investigate wrong doing. accordingly I went and pulled copies of the job descriptions including hers proving it was in fact Their Job!
I have reported the above to the Governor Strickland as well as the Inspector General.
The Ohio Fair Claims Settlement Practices act Is Broken In Ohio while it exists on paper the Director/Superintendent who is an Attorney, and signs documents stating that she knows the Insurance laws pertaining to Ohio fails to do her job and enforce existing provisions or request the needed changes to make a enforceable new law!
